The Archive Collective

Terms of Service

These Terms govern access to The Archive Collective website and use of our curated sourcing, inspection, and acquisition service.

Our Service

The Archive Collective operates as a curated sourcing and acquisition service. Pieces displayed on the website may not be physically held by The Archive Collective. “Available for Sourcing” means we may be able to locate an appropriate example matching the listed specifications; it is not a promise that a specific item is currently secured or available.

Availability is not guaranteed until the exact item has been located and verified. Third-party availability can change without notice.

Archive Images and Product Information

Website photographs may be archive or reference images and may not depict the exact physical item ultimately considered for acquisition. Product information shown on the website describes the listed model or intended specifications. The exact item’s size, condition, measurements, tags, details, notable wear, and other material characteristics will be confirmed during the inspection process.

Inspection Sets

You may request an Inspection Set before purchasing. After a request, The Archive Collective attempts to locate an available example and inspect or verify that exact item. The Inspection Set is intended to show the exact item being considered for acquisition and may include photographs and relevant condition information.

Submitting an Inspection Set request is not a purchase and does not itself create an obligation to pay. You will have an opportunity to review the exact item before payment is collected.

Pricing and Availability

Displayed prices reflect the information available when listed. A price may change before an acquisition is finalized if availability, market pricing, condition, size, logistics, taxes, duties, or other sourcing conditions change. Any material change will be disclosed before you approve and pay for the acquisition.

We may decline or cancel a sourcing request when an appropriate item cannot be located or verified, information is inaccurate, or completing the acquisition would be unlawful or commercially unreasonable.

Approval, Orders, and Payment

An acquisition proceeds only after the exact item has been presented through an Inspection Set, you approve it, and payment arrangements are confirmed. Your approval represents that you reviewed the provided information and wish to acquire that item. Orders remain subject to payment authorization and final confirmation.

Approved and paid acquisitions are governed by our Returns & Refunds / Final Sale Policy.

Customer Responsibilities

You agree to provide accurate contact, size, billing, and delivery information; review the Inspection Set carefully; ask questions before approval; maintain the confidentiality of any account credentials; and use the website only for lawful purposes. You must not interfere with website security, misuse content, submit fraudulent requests, or infringe another person’s rights.

Intellectual Property

The website’s branding, written material, layout, and original graphics belong to The Archive Collective or its licensors. Product names, trademarks, imagery, and other third-party materials belong to their respective owners. No content may be copied, modified, distributed, or commercially used without authorization where applicable.

Disclaimers

We provide the website and sourcing service on an “as available” basis. To the extent permitted by law, we do not warrant uninterrupted website access, promise the availability of a listed piece, or represent that every reference image will match every characteristic of a sourced item. Exact-item information is supplied through the Inspection Set. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

Limitation of Liability

To the extent permitted by law, The Archive Collective will not be liable for indirect, incidental, special, or consequential losses arising from website use, third-party availability, or delays outside our reasonable control. Any limitation applies only to the extent lawful and does not limit liability that cannot legally be limited.

Dispute Resolution and Governing Law

Please contact us first so we can attempt to resolve a concern informally. If a dispute cannot be resolved, it will be handled in the courts or other forum with jurisdiction under applicable law. These Terms are governed by the laws of [GOVERNING-LAW JURISDICTION], without overriding consumer protections that apply in your place of residence.

Changes and Contact

We may update these Terms as the service develops. Updated Terms apply from the date posted and do not retroactively alter an already approved acquisition unless required by law. Questions may be directed through our Contact page.
